FMCSA Expanded the Crash Preventability Determination Program
On December 1, FMCSA expanded the Crash Preventability Determination Program (CPDP) to now include 21 eligible crash types for review. FMCSA expanded eligibility for current crash types to include indirect strikes and added four new crash types.
Under the CPDP, if you were involved in an eligible crash, you may submit a Request for Data Review (RDR) with the required police accident report and other supporting documents, photos, or videos through the Agency’s DataQs system. FMCSA cannot accept crashes older than five years.
Crashes determined to be Not Preventable through CPDP are removed from the calculation of the Crash Indicator Behavior Analysis and Safety Improvement Category (BASIC) in FMCSA’s Safety Measurement System (SMS), but are still listed. Not Preventable determinations are also noted in FMCSA’s Pre-employment Screening Program.

Return-to-Duty for CDL Drivers
As of November 18, 2024, the second Clearinghouse final rule (Clearinghouse II) is in effect. This means that commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders that have a “prohibited” status in FMCSA’s CDL Drug and Alcohol Clearinghouse will lose their State-issued commercial driving privileges until the driver completes the return-to-duty process. FMCSA developed a new video that summarizes the steps drivers must take to change their Clearinghouse status from “prohibited” back to “not prohibited.” Watch the “Return-to-Duty Process for CDL Drivers” video. FMCSA Updates SMS Website
FMCSA has updated the SMS Website with the November 29, 2024 results. Complete SMS results are available to enforcement users and motor carriers that are logged into the SMS Website.
Note: the Prioritization Preview Website continues to be updated monthly alongside the SMS Website. Motor carriers can visit the Preview site and log in to see what their prioritization results would be under the proposed new methodology.
